Petition

The constitutional right to petition public authorities, and what happens when petitions are refused.

In Brazil, any person may address a public authority in writing to defend a right or to challenge an abuse. The right of petition is not a favour granted by an office; it is a guarantee found in the Constitution, and it does not depend on having a lawyer.

In practice the right only works if the request is received and registered. A petition that is handed over and then treated as if it never arrived leaves no trace in the system, and the citizen cannot prove that the institution was ever informed.

This topic explains what a petition is, how an ordinary person can present one, and what options remain — ombudsman offices, prosecutors, public defenders — when a petition is refused at the counter.
